Denisova proposes to modify the law on surrogacy

Amendments to the law on the issue of surrogate motherhood should strengthen the requirement to use reproductive technologies exclusively for citizens of Ukraine.

This was reported by the press service of the Office of the Representative of the Verkhovna Rada of Ukraine for Human Rights.

“It is to guarantee the monitoring of respect for the rights of the child that the Commissioner considers it appropriate to amend the Family Code of Ukraine, the relevant legislation and to consolidate the requirement relating to the possibility of using techniques surrogacy only for Ukrainian citizens, “the statement said.

According to the press service, the Commissioner noted that the provision of surrogate motherhood services to foreigners “leads first of all to a violation of the rights of the child and to a situation in which Ukraine is not in able to control the future fate of children and protect its citizens. “

“From now on, fertilization and the birth of a child using surrogate methods are governed by article 123 of the Family Code of Ukraine and the Procedure for the Use of Assisted Human Reproduction Techniques in Ukraine , approved by decree of the Ministry of Health of Ukraine dated 09/09/2013 No. 787 “, said the press service.

At the same time, as indicated to the Ombudsman’s Office, such regulations “demonstrate their imperfection and leave a wide margin for fraud and criminal acts which lead to the illegal export of newborns abroad”.

Earlier, Deputy Minister of Home Affairs Anton Gerashchenko said that the Verkhovna Rada should solve the problem of surrogacy in order to exclude the sale of children abroad.

As Ukrinform reported, on April 25 in Kiev, the activities of a group of people ceased, which established the movement of infants abroad under the guise of a surrogacy program.
