The Verkhovna Rada Committee recommends the adoption of bill No. 3112 “amending the Ukrainian law” on enforcement procedures “at first reading (concerning the obligation of the contractor to index the amount of the pension court-determined support in a solid monetary amount). “

It is reported by the Information Department of the Verkhovna Rada.

“The Legal Policy Committee recommends that the Verkhovna Rada adopt as a basis a bill on the obligation of the contractor to index the amount of alimony determined by the court by a fixed amount,” the statement said.

The project provides for the elimination of conflicts in legislation and the partial reduction of the burden on local general courts and the competent courts of appeal and cassation.

To this end, the bill proposes modifications to the first paragraph of part four of article 71 of the law on enforcement procedures, in which the contractor is required to index annually the amount of maintenance determined by the court for a fixed amount.

One way to fulfill the maintenance obligation is to provide cash support. The Family Code of Ukraine (second part of article 184) stipulates that the amount of maintenance determined by the court in a fixed amount is subject to indexation in accordance with the law.

Indexation of cash income, aimed at maintaining the purchasing power of the population in the face of rising prices in order to respect the right established by article 48 of the Constitution to ensure an adequate standard of living for the population Ukrainian.

It should be noted that the adoption of the bill will help to: improve the financial situation of people whose amount of child support is determined by the court in a solid amount in cash; reduce the burden on the state budget due to a reduction in the number of beneficiaries of social payments and / or a decrease in the size of these payments; reduce the burden on local general courts and the competent courts of appeal and cassation.
