On December 17, 2018, Marchenko was arrested by the “MGB DPR”. After a stay of two months in the prison “MGB DPR”, he was taken to the border of Ukraine and the Russian Federation and handed over to the representatives of the FSB of Russia. For almost two and a half months, he was detained through administrative arrests in the deportation center in Krasnodar territory. Criminal proceedings against Marchenko were only opened on April 30, 2019. As relatives of Marchenko explain, in 2014 he drove his car to a petrol station in Donetsk. Due to the onset of the Russian aggression and the war, he was unable to take transportation for the repairs. In December 2018, an acquaintance by the name of Marchenko said it seemed that the man who had illegally driven his car had fled Donetsk, so there is a possibility of coming to town and returning the car. Relatives of the Ukrainian citizen claim that his testimony was beaten by torture.
In December 2019, the Memorial Human Rights Center recognized the Ukrainian Marchenko as a political prisoner.
