On June 16, the Verkhovna Rada adopted a law on state support for culture, the creative industries and tourism as part of the restrictive measures linked to the distribution of COVID-19.

Relevant draft law no. 3377, “amending certain legislative acts concerning State support for culture, the creative industries, tourism, small and medium-sized enterprises in relation to restrictive measures linked to the spread of the coronavirus disease (COVID-19) “, second reading, with the necessary information 343 deputies of the people supported the technical and legal amendments, reports a correspondent for Ukrinform.

The law introduces a reduction in the rental costs of a property at the request of a cultural institution carrying out an entrepreneurial activity using this property, for the entire period during which the property could not be fully used by the employer in because of restrictions and prohibitions.

A journalist from a television and radio organization has the right, after presenting an editorial certificate or other document confirming his professional affiliation or the authority granted by the television and radio organization, to be in the field natural disasters, disasters, at the scene of accidents, riots, at rallies and demonstrations, in areas where an emergency is declared or state of emergency.

In addition, the law temporarily stops, for the period of implementation of measures to prevent the emergence and spread of COVID-19, the launch, announcement and holding of contests by the National Television Council and from the radio.

Television and radio organizations and program service providers use a radio frequency resource; until December 31, 2020, 50% of the cost of Concern services for broadcasting, radiocommunications and television is exempt.

In addition, at the end of the year, commercial entities which have suffered losses due to restrictions or prohibitions on activities under quarantine conditions receive aid from the State.

By introducing the appropriate amendments to the law “on the Ukrainian Cultural Fund”, institutional support is introduced for the stable functioning and development of legal entities of all forms of property in the fields of culture and the arts, including in the conditions of restrictions introduced on economic activity due to an emergency or a state of emergency.

The law also defines state support for cinematography in the form of a state subsidy for the development of cinematographic projects: for national feature films, animated films, documentaries, films for children. (taking into account artistic and cultural importance), films of artistic and cultural importance (copyright), television films, television series and first films, up to 100% inclusive of the total estimated cost of development of the corresponding film project.

In addition, it has been established that the law “on the effective management of the property rights of copyright holders in the field of copyright and / or neighboring rights” temporarily, until December 31, 2020 , does not apply to cultural institutions, program service providers and commercial entities that carry out the main economic activity in the field of creative industries by type of economic activity approved by the Cabinet of Ministers, as well as the ” improvement of certain provisions of relations with users, the collection of remuneration and deductions from users.

The Cabinet of Ministers is responsible for clarifying and detailing the list of companies whose activities are subject to restrictions and / or prohibitions during quarantine within three days from the date of entry into force of the law, by modifying the government decree “On the prevention of the spread of acute respiratory diseases” the disease COVID-19 caused by the coronavirus SARS-CoV-2 “dated March 11, 2020 n ° 211, and within one month – to develop and approve the procedure and conditions for granting state support to cinematography in the form of a state grant for the development of a film project.

In addition, within one month, the Cabinet of Ministers undertakes to develop and introduce amendments to the State budget of Ukraine for 2020 concerning public subsidy of 50% of the cost of the concern of radio, radio and television for electric power.

Within one month from the date of entry into force of this law, the government should draft and introduce in BP a bill amending the State budget of Ukraine for 2020 concerning the State subsidy of 100% of local budget losses resulting from the support measures provided for in this bill (temporarily at the expense of funds for coronavirus disease).

This law comes into force the day after its publication in the parliamentary newspaper “Voice of Ukraine”.
