The Supreme Anti-Corruption Court quashed the absentee arrest decision of former Minister of Revenue and Functions Alexander Klimenko because the prosecution has failed to provide evidence that the suspect was listed on the international list of wanted persons.

In particular, it is noted that the panel of judges established that on June 10, 2019, as part of the criminal proceedings, the prosecutor of the military prosecutor’s office had “really taken a procedural decision in the form of a decision”, which Klimenko recorded on the international list of wanted persons.

“However, the prosecution has added no evidence that the preliminary investigative body has taken steps to implement the relevant decision, in particular evidence that the person has been placed on the international list of wanted persons in Edrey and that the request for the list of wanted persons has been sent to the National Central Bureau of Interpol in Ukraine “, according to the report.

At the same time, the WAKS noted that this court decision does not deprive the prosecution of the right to seize the investigating judge again if these breaches are eliminated and does not constitute a reason for exoneration of the suspect from his criminal responsibility or closing the procedure.

The day before, it was learned that the Appeals Chamber of the Supreme Anti-Corruption Court had canceled, on May 13, the arrest by absentee of the former Minister of Revenue and Functions, Alexander Klimenko.

As reported, in August 2019, the Kiev Pechersk District Court arrested Klimenko in absentia. The Attorney General’s Office also reported on the completion of an investigation into the missing persons against him and several others.

Alexander Klimenko left the country during the Dignity Revolution because May 2014 is on the wanted list. He is notably accused of having organized illegal activities of the so-called “tax platforms”.
