The Supreme Anti-corruption Court refused on Monday April 20 to the prosecutor of the specialized anti-corruption prosecution to detain the ex-president of “Ukrbud” Maxim Mikitas, although he has not made a deposit of 100 million ‘UAH.

The prosecutor said at the meeting that Mikitas did not deposit 100 million UAH on bail, which was named as an alternative to coercion.

“As the pledge has not been paid, article 182 of the Criminal Code, taking into account Mikitasa’s financial situation and income, gives me the opportunity to ask the judge to apply a preventive measure to the suspect in the form of detention until April 14, 2020, “said the prosecutor.

However, WAKS investigating judge Ekaterina Shirokaya rejected this request.

As indicated, on April 16, the WAKS Appeals Chamber postponed the examination of the appeal concerning the collection of 80 million UAH on bail from the former people’s deputy on April 29 under state revenues.

The former president of Ukrbud Mikitsa is suspected of appropriating National Guard property.

According to investigators, the Ukrainian National Guard and developer Ukrbud reached an agreement that a residential complex should be built on the territory of the former military unit.

In exchange, the National Guard was supposed to get 50 apartments and 30 parking spaces there. However, in 2016-2017, the parties concluded additional agreements by which the National Guard refused apartments and parking spaces in Pechersk in exchange for 65 apartments in a house on the outskirts of Kiev. As the review established, the cost of apartments on the outskirts is 81635448 UAH lower than that in which the apartments in Pechersk were valued.

On October 4, 2019, the WAKS panel of judges elected Mikitas a preventive measure in the form of an arrest with the right to pay a deposit of 5.5 million UAH. A promise was made to him and he was released.

However, this SAP court decision appealed to the WAKS Appeals Chamber. Finally, the court accepted the prosecution’s complaint concerning the increase in the bail and chose Mikitas as a preventive measure in the form of an arrest with the right to post bail in the amount of 80 million UAH. After that, Mikitasha was arrested in the courtroom.

On October 25, 80 million UAH were pledged for Mikitas. Under the terms of the preventive measure, Mikitas was required to wear an electronic bracelet, hand over his passport and report to the investigator on request and not communicate with witnesses to his case.

On April 3, WAKS collected 80 million UAH in state guarantees, which was made by Mikitasem.
